Welcome to Instachat (“Instachat”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the Instachat application, website, and related services (collectively, the “Service”).

By accessing or using Instachat, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Instachat is a software platform that enables businesses to connect their Instagram Business accounts and Facebook Pages to manage, respond to, and automate Instagram Direct Messages and comments using Meta-authorized APIs.

Instachat operates only with user authorization and does not access accounts without permission.

2. Eligibility

You must:

  • Be at least 18 years old, and
  • Have the authority to manage the Instagram Business account and Facebook Page you connect to Instachat.

You are responsible for ensuring that your use of the Service complies with all applicable laws and platform policies.

3. Account Access and Authorization

To use Instachat, you must authenticate via Facebook Login and grant permissions to access your connected Instagram Business account and Facebook Page.

You may revoke access at any time through:

  • Instachat account settings, or
  • Facebook / Instagram app settings

Instachat does not store Facebook or Instagram passwords.

4. User Responsibilities

You agree that you will:

  • Use Instachat only for lawful business purposes
  • Comply with Meta Platform Terms, Instagram Platform Policies, and applicable laws
  • Not use the Service for spam, abusive, deceptive, or misleading messaging
  • Not attempt to bypass platform restrictions or safeguards

You are solely responsible for the content of messages, replies, and automations you configure.

5. Automation and Messaging Disclaimer

Instachat provides tools to automate messaging and comment replies. You acknowledge that:

  • You are responsible for configuring automations appropriately
  • Automated messages must comply with Instagram and Facebook policies
  • Instachat is not responsible for account restrictions or enforcement actions taken by Meta due to your usage

6. Data Usage and Privacy

Instachat collects and processes data in accordance with its Privacy Policy, which forms part of these Terms.

By using the Service, you consent to the collection and use of data as described in the Privacy Policy.

7. Service Availability

We strive to provide reliable service, but Instachat is provided on an “as is” and “as available” basis.

We do not guarantee uninterrupted or error-free operation and may modify, suspend, or discontinue parts of the Service at any time.

8. Intellectual Property

All rights, title, and interest in the Instachat platform, including software, design, and branding, are owned by Instachat or its licensors.

You may not copy, modify, distribute, or reverse engineer any part of the Service without written permission.

9. Termination

We may suspend or terminate access to Instachat if:

  • These Terms are violated
  • Required platform permissions are revoked
  • Use of the Service poses legal, security, or compliance risks

You may stop using the Service at any time by disconnecting your accounts.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Instachat shall not be liable for indirect, incidental, or consequential damages
  • Instachat is not responsible for losses resulting from platform changes, API limitations, or enforcement actions by Meta

Your use of the Service is at your own risk.

11. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date.

Continued use of the Service constitutes acceptance of the updated Terms.
